Terms of Use and End User License Agreement

1. Acceptance of Terms

These Terms of Use and End User License Agreement (collectively, the “Agreement”) together with all documents referenced herein, form a legally binding agreement between you (the “user” or “you”) and Health_Innovation (referred to as “we,” “us,” or “our”), concerning your access to and use of the EasyFast-Calorie Counter mobile application (the “App”). The App’s title may vary in different countries and is subject to change without notice.

By downloading, installing, or using the App, you confirm that you have read, understood, and accepted this Agreement, which takes effect upon your first download, installation, or use of the App. If you do not agree to the terms of this Agreement, you must not access, download, install, or use the App. If you have already done so, you must immediately delete the App from your device.

2. User Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to access and use the App. Users under the age of 18 (generally between 13 and 17 years old) must obtain explicit consent from a parent or legal guardian. By granting permission, the parent or guardian assumes full responsibility for supervising and monitoring the minor’s usage of the App and ensuring compliance with this Agreement.

Parents and guardians are responsible for preventing any unauthorized, inappropriate, or harmful use of the App by minors. We disclaim any liability arising from misuse of the App by underage users.

3. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful or prohibited purposes.
  • Post or transmit harmful, offensive, or defamatory content.
  • Attempt to hack or compromise the security of the App.
  • Misrepresent your identity or personal data.
  • Distribute viruses, malware, or harmful software through the App.

You further agree to:

  • Upload only content for which you have obtained all necessary permissions or are the exclusive copyright holder.
  • Refrain from infringing on any third-party rights.
  • Not modify, reverse-engineer, decompile, or disassemble the App, or create derivative works from it.
  • Not transfer, rent, lease, or distribute the App to any third parties.

4. Payments and Subscriptions

The App is available for free, but some services and features, referred to as “Premium options,” require in-app purchases or paid subscriptions. Details regarding Premium features and pricing are provided on the App’s information page.

When subscribing, you may be offered a free trial, after which a recurring subscription will start unless canceled at least 24 hours before the end of the trial period. Prices vary by country and are indicated in the respective local currency. You can manage and cancel your subscription through your Apple ID account settings. Removing the App from your device does not deactivate your subscription. No refunds will be issued for unused portions of active subscription periods unless required by law.

5. Availability, Security, and Accuracy

You need a compatible mobile device and internet access to use the App. The App is compatible with Apple iOS devices running version 16.0 or later. We do not guarantee the App’s compatibility with all devices or operating systems.

The availability and performance of the App may be affected by factors beyond our control, such as network issues. We reserve the right to modify or discontinue the App without prior notice, including for maintenance or updates.

You must ensure that any information provided to us is accurate and up to date. The App may be updated periodically to add new features or fix bugs.

6. Disclaimer of Warranties

Your use of the App is at your sole risk. The App, including all services, content, and information, is provided “as is” and “as available” without any warranties of any kind. We do not guarantee uninterrupted access, freedom from errors or viruses, or compatibility with all hardware and software configurations.

All information in the App is for educational purposes only and should not be considered a substitute for professional medical advice. Consult a healthcare provider before making changes to your diet or health regimen.

You are responsible for any health-related decisions made based on information in the App. We are not liable for any health problems, injuries, or damages arising from the use of the App.

7. Limitation of Liability

We are not liable for any direct, indirect, special, incidental, or consequential damages arising from your use of the App, including loss of profit, revenue, or data, even if we were advised of such possibilities. We are not responsible for third-party content or services accessible through the App.

8. Changes to the Agreement

We reserve the right to modify this Agreement at any time. Any changes will be posted in the App, and it is your responsibility to review the Agreement periodically. By continuing to use the App after the revised Agreement is posted, you agree to accept any changes made.

9. Termination

We may terminate this Agreement at any time for any reason. Upon termination, you must cease all use of the App and delete it from your device.

10. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
